Tom's Take: Fortunately, and unlike Washington, the Legislature and Governor will agree on a balanced budget. Constitutionally, this is the only thing that we absolutely must do before we adjourn in May. All other bills are optional. Budget and tax packages may get some test votes this week. The Senate Tax committee rolled out its version, SN Sub for HB 2059, of a revenue package a couple weeks ago but it has yet to show up for a full Senate vote. My suspicion is that the votes are not there to pass it. What they are offering is largely the Governor's suggestions of making permanent the expiring temporary sales tax increase of three years ago that will generate $250 million and also eliminating the home mortgage interest deduction that will add $162 million to the state revenue from itemized income tax returns.

In any case, at this point the Senate package would be dead in the House. However the House tax committee has not offered any revenue package as yet. The $704 million dollar revenue reduction that our Governor signed into law last spring is proving, as I suggested at the time, a hole to large to fill. None the less, we can use ending balances, trim less essential services and rely upon a growing economy to help us. In the meantime, budget building will be messy, frustrating, and scary. You are not alone in the struggle with math.

School Funding: The House Appropriations and Senate Ways and Means Committees plan to finalize their proposals for supplemental appropriations this year and funding for state agencies, including K-12 education funding, for the next two years, FY 14 and FY 15. To this point, both committees have maintained the Governor's budget recommendations, which fund base state aid at $3,838 in FY 14 and $3,852 in FY 15. This maintains level funding for the Local Option Budget and special education state aid by using state highway funds for partial funding of transportation weighting and special education aid and provides a formula increase for capital improvement aid and KPERS payments.

Innovative Districts (SB 176 and HB 2319): Both the House and Senate passed virtually identical bills which would establish a process for a limited number of districts to be designated ''innovative districts.'' This would allow them to be exempted from most state school laws and regulations in exchange for higher student performance and completion standards. The Senate bill allows up to 10 percent of school districts, 28 of them, to become innovative districts; while the House bill is limited to a total of 10 districts.

Teacher Negotiations (HB 2027): The House Commerce, Labor and Economic Development Committee last Friday completed two days of hearings on this bill which would make changes to the Professional Negotiations Act as recommended by Kansas Association of School Boards (KASB) and the Kansas School Superintendents Association (KSSA). Most significantly, the bill would narrow the list of items which are ''mandatorily'' negotiable under current law.

KASB and KSSA testified the purpose of the bill is to give local boards and administrators more flexibility in areas such as teacher evaluation, discipline, attire and reduction in force, while still maintaining the right of teachers to collectively bargain over compensation, amount of time worked and other ''permissively'' negotiated items. KASB recommended several amendments to make clear boards must continue to negotiate with a single bargaining association for teachers.

The bill also gives boards more authority to provide additional compensation based on teacher performance or shortage areas. Teacher unions do not like most of these proposals. We will soon see what comes out of committee.

Turnpike (HB 2234): The Governor suggested and the House denied the full merger of the Kansas Turnpike Authority and the Kansas Department of Transportation. The full House did pass a bill which does little more than to encourage more cooperation between the two. Governance remains separate as do budgets, powers and duties. This now goes to the Senate for action.

Switch Blade Regulation (HB 2033): The House voted to prohibit local units of government from regulating the transportation, possession, sale, transfer, purchase, licensing or registration of knife and knife making components.

This was favored by the NRA and others as a second amendment right. It was opposed by law enforcement because of the implications for police and public safety. But yet it passed 93-28. I voted no. We have given gangs and thugs a weapon that police will not have the ability to control. These are lethal weapons with no licensing and no restrictions allowed. A former sheriff and current House member, who also voted no, told me that these blades will penetrate a normal bullet-proof vest. If you have thoughts about this please contact me and your senator.
