Kansas Realtors back homeowner tax break plan

The Kansas Association of Realtors lobbied Wednesday for a compromise to preserve a partial tax break for homeowners ahead of a debate in the state Senate on income tax legislation.

The Republican-dominated Senate was preparing to take up a bill to phase in a second round of income tax cuts over the next four years. GOP Gov. Sam Brownback and many Republican legislators want to phase out personal income taxes, arguing that it will boost economic growth. A round of massive personal income tax reductions were enacted last year.

But to stabilize the budget, the bill before the Senate would eliminate the state’s income tax deduction for the interest homeowners pay on their mortgages. The measure also would prevent the state’s sales tax from dropping in July as scheduled under state law.

Real estate agents have lobbied to preserve the full home mortgage interest deduction, and their association spent more than $195,000 in January on radio, television and Internet ads attacking Brownback’s proposal to scrap it. But lobbyist Luke Bell said the group was urging senators to reject attempts to save the full deduction. The group would back a plan to phase out all income tax deductions as rates drop, which would preserve a partial break for homeowners, he said.

“It’s a reasonable compromise,” Bell said ahead of the Senate’s debate.

Several GOP senators said they expected their chamber to consider the compromise but weren’t sure whether a majority would support it. The governor spoke briefly to Senate Republicans on Tuesday night to pitch his plan before they had a closed meeting at a downtown Topeka office building to discuss tax issues.

“This works and it fits together, but it’s not without difficulty,” the governor told the senators. “It’s not without a lot of moving parts.”

Bell said that if senators substitute the phasing out of all income tax deductions for elimination of the mortgage interest deduction, his group “will run radio ads” in a campaign to support the revised plan.

But Sen. Pat Apple, a Louisburg Republican, said he’d rather eliminate the mortgage interest deduction. If lawmakers phase out all deductions, they’ll reduce what Kansans can claim for contributions to charity.

“I’m willing to take the tough votes,” Apple said. “But the thing that’s off limits to me is charitable contributions.”

Brownback has received national attention for seeking aggressive income tax cuts. On Tuesday, the Missouri Senate approved income tax cuts prompted by a desire to keep up with Kansas, and the Oklahoma House passed a plan to reduce income taxes backed by Republican Gov. Mary Fallin.

Under the bill before the Kansas Senate, the state would drop its top tax rate to 3.5 percent from 4.9 percent in 2017.

Critics note eliminating income taxes would force the state to rely most heavily on its sales tax to finance its programs — and poorer families tend to pay a higher percentage of their incomes to that tax than wealthy ones. And unlike most states, Kansas imposes the full tax on groceries.

The Kansas sales tax is 6.3 percent but is set to drop to 5.7 percent in July. Lawmakers and Brownback’s predecessor, then-Democratic Gov. Mark Parkinson, boosted the sales tax three years ago to balance the budget but promised most of the increase would be temporary.

Senate Democrats promised to offer a proposal to allow the sales tax to drop as scheduled, as well as measures to restore several tax breaks for poor families eliminated last year when the state overhauled its income tax code.

Meanwhile, the House Taxation Committee on Tuesday approved a plan from its Republican chairman that would decrease the sales tax as planned and phase out all income tax deductions. But it’s less aggressive in cutting individual income tax rates than Brownback’s plan.
