My Take: There are ridiculous elements in both political parties. Right now the extremes seem to be holding sway. That will change as politicians learn that true success comes when everyone wins. When the vast middle class of Americans succeeds it follows that the country as a whole will prosper.

In the last 10 years the average hardworking American has actually lost 7 percent of his/her buying power because of inflation and stagnant wages. No wonder everyone is pointing fingers and thinking he is the one getting the raw deal. Wall Street has come back already, and in Kansas we have relatively low unemployment but it doesn't feel prosperous yet.

Week 3— Let the Debate Begin!

This week debate on key measures got started in both chambers. The Senate debated and approved the highly publicized issue of judicial selection and the House debated and approved a controversial Union bill. Committees have stepped into high gear churning out bills and we can expect the debate schedule to ramp up in the next couple of weeks. While this process may be old hat to returning legislators, there are plenty of freshman rolling up their sleeves and digging into the process for the first time.

Judicial Selection: Last week the House Judiciary Committee took up HCR 5002, a constitutional amendment allowing the governor to appoint Supreme Court justices and Court of Appeals judges as well as adding Senate confirmation and abolishing the Supreme Court Nominating Commission. The proposal recommends placing the measure on the November 2014 General Election ballot if it were to gain a 2/3 majority (84 votes) in the House and 2/3 majority (27 votes) in the Senate. The measure now goes to the full House of Representatives for consideration.

We currently have a ''merit system,'' which allows the Governor to appoint judges from three finalists chosen by a nominating commission. The commission is comprised of nine people — five lawyers selected by the Kansas Bar Association and four non-lawyers selected by the Governor. The proposed system is a political system solely left to the Governor. In other states with similar political type selection systems there have been scandals due to corruption and influence buying charges. My position is that the merit system is not broken, so why fix it?

Unions and how they operate

There was buzz around the capitol all week about HB 2023, a little publicized bill prohibiting members of public employee unions from paying membership dues or other fees to their unions through payroll deductions. On final action, the measure was approved 68-56. I voted ''no'' as I have not heard from even one aggrieved constituent who was intimidated into paying into a public employees union. This is a clear case where the government is trying to interfere with the individual liberties of its citizens. Having passed however, the measure will now go to the Senate for their consideration.

Other bills being considered by the House Commerce Committee include: HB 2123, the Public Employees Freedom Act, which would make collective bargaining optional for school boards and stop teachers from making any payments to unions through payroll deductions. HB 2085 amends the professional employee negotiation procedures and limits the terms and conditions of professional service that are negotiable.

Taxes: The Race to Zero

Tax discussion heated up this past week when the Governor's Tax Proposal was introduced in both the House and Senate. This proposal offers more income tax rate reductions. There currently is an $850 million deficit to fill in order to keep the promises the Governor has made in his proposed budget. Cutting taxes further deepens that hole.

The latest revenue package offered by the Governor last week is a proposal that includes:

* Retaining the sales tax rate at 6.3 percent rather than reducing it to 5.7 percent in July as scheduled.

* Decreasing individual income tax in the lower bracket from the 3.5 percent (2012 level to 3.0 percent (2013 level) to 2.5 percent in tax year 2014 then further reduce that to 1.9 percent in tax year 2016.

* Reduce the higher tax bracket from the 6.45 percent (2012 level) and 4.9 percent (2013 level) to 3.5 percent in tax year 2017.

* After tax year 2015 any income tax growth in excess of 4 percent would further reduce income tax rates in future years

* Eliminate the deductions on residential mortgage interest and real property taxes.

* Bottom line impact is that there would be a huge shift in state revenue to sales and property tax. This is not a reduction in total size of government but rather who pays.

Executive Reorganization Order #42

This week, the House Corrections and Juvenile Justice Committee will hold two days of hearings on the Governor's recent Executive Reorganization Order (ERO) #42 which would consolidate the Juvenile Justice Authority (JJA) into the Department of Corrections (DOC). The Senate Judiciary Committee will also hold a hearing on the ERO on Thursday.

As with all ERO's, the Legislature has 60 calendar days to reject the ERO. If neither chamber rejects it, it will go into effect on July 1. As I sit on this committee, I will be paying close attention to how we merge a punitive system (DOC) for adults with a truly rehabilitative/teaching system (JJA) for youth.
