My Take: The Governor's budget is built like a house of cards on an uneven base because to work it depends upon unlikely new revenue.

He advances a vision of governance and the role of government that reduces reliance upon income tax for some and increases the burden of sales taxes and probably property taxes for others. The tax bill (HR2117) pushed and passed by the Governor last spring leaves a reduction in revenue of $829 million in FY14.

To fill that huge hole, the Governor recommends we raise revenue by method #1 below, plus shift money to other uses from funds already dedicated for highways and other functions. Please note that in FY 13 the all funds budget is $14.3 billion and his recommendation for FY14 is $14.6 billion. This slight of hand is only possible with a shifting of funds and the unlikely acceptance of his revenue package. All of this puts the legislature in the unenviable position of doing the budget balancing for FY 2013, FY2014 and possibly FY2015.

To the extent that the legislature may want to alter either the Governor's budgetary assumptions or advance funding in particular line items beyond his recommendations, one of the following courses of action or a combination of them will be need to be used to fill the revenue short fall.

1. The Governor's plan is to reauthorize the expiring temporary sales tax 0.06 percent ($262 million), eliminate the mortgage deduction ($162 million), and eliminate the property tax deduction ($69 million). This notion hits all Kansans but homeowners the hardest.

2. Reduce the sales tax rate but broaden its coverage to include a broad list of currently exempt items like attorney's and accounting fees, haircuts, feed, farm equipment and repairs, etc. This has a negative effect on the economy both at the service provider and the consumer levels.

3. Raise the statewide mil levy on property, which has been as high as 35 mils in the 90s and currently is 20 mils. Again this is not a good way to keep a recovering economy prospering.

4. Undo the income tax breaks that are to take effect this year ($520 million). For various reasons this politically will not happen as it would not be signed into law.

5. Sweep even more funding from the Department of Transportation (Governor currently is taking $122.5 million) and run the risk of not being able to build and maintain our good roads and bridges.

6. Lower higher education funding, which has essentially been flat for 7 years.

7. Lower K-12 funding from the Governor's budget recommendation of flat funding for FY2014, which flies in the face of the recent court opinion (see below).

8. Pierce the 7.5 percent ending balance of $480 million and take it dramatically lower, knowing that by doing so it places the FY 15 budget in a position of potential disaster.

So the predicted upheaval is occurring in state government funding and if the legislature follows the Governor's recommendation the result is a shift in who pays for state services. Not a reduction in spending.

School Finance ... a walk down memory lane.

Prior to the start of the 2013 Legislature, a three judge panel in Shawnee County District Court ruled in the Gannon v. State case. The plaintiffs, a group of unified school districts, filed suit against the State of Kansas, alleging that the state violated the Kansas constitution by failing to ''make suitable provision for finance of the education interests of the state.''

The district court ruled in favor of the plaintiffs and Attorney General Derek Schmidt has already stated his intent to appeal the decision.

The makeup of the 2013 Kansas Legislature is much different than in past sessions, but that has simply heightened the drive and focus of new legislators to bring innovative ideas to the table. At the same time, many returning legislators look to bring their years of experience to some of the key issues Kansas faces and education funding is a big one.

This case comes on the heels of the Montoy series of Kansas Supreme Court opinions. The Montoy case was filed in December 1999, alleging the Kansas Legislature failed to ''make suitable provision for finance.'' The Kansas Supreme Court ruled in January 2005 that the Kansas Legislature failed to meet the burden required by the Kansas Constitution and gave the legislature until April 12, 2005 to enact legislation that corrects the problem.

Although the legislature passed multiple bills, adjusting the school finance formula and appropriating an additional $141.1 million, it wasn't enough according to the Kansas Supreme Court.

The Court issued another opinion in June 2005 citing a ''continued lack of constitutionally adequate funding'' and gave the legislature until July 1, 2005 to correct the problem. Then Governor Kathleen Sebelius called the legislature back for a Special Session to resolve the issue. The Legislature passed House Substitute for SB 3, making additional changes to the school finance formula and adding another $148.4 million for the school year 2005-06, resulting in a total increase of $289.5 million.

When the Legislature returned in January 2006, they approved a three-year school finance plan that increased school funding $194.5 million in school year 2006-07, $149 million in school 2007-08 and $122.7 million in school year 2008-09. The passage of this legislation made Base State Aid per Pupil $4,400.

Over the next several years as allotments were made and the economy worsened, that number was lowered. The current Base State Aid per Pupil is $3,838, which is about $440 million below the level that satisfied the courts previously. At this point it is too early to tell how the new court ruling will effect education funding discussions this session.
