Lawmakers move to tighten budget-making rules

Conservative Republicans who hope to slim down state government are preparing to rewrite the GOP-dominated Kansas Legislature’s internal rules to make it harder for more liberal colleagues to slip extra dollars to agencies and programs during budget debates.

A version of the new rule, known as “pay-go” — short for “pay as you go” — could be in place for both chambers within days. The Senate added the measure last week to its proposed version of the Legislature’s joint operating rules, and the House is expected to consider the package by the end of the week. The Republican supermajorities in each chamber are controlled by conservatives who favor the rule.

The rule would apply when either the full Senate or House is debating the budget. It says that a lawmaker who wants to boost spending for a particular agency or program must propose offsetting cuts elsewhere. Once a proposed spending plan clears committee, the total amount of spending can’t be increased.

The House has had a version of “pay-go” in its internal rules for the past two years, but the restriction didn’t apply in the Senate, which was led by moderate GOP leaders until conservatives toppled them in last year’s elections. Backers of revising the rules believe it will help Republican Gov. Sam Brownback and his allies phase out state income taxes by increasing the Legislature’s fiscal restraint and curbing the urge of members — even, sometimes, GOP conservatives — to bulk up pet projects or programs.

“We need to prioritize and spend within limits,” said Rep. Kasha Kelley, a conservative Arkansas City Republican who serves on the House Appropriations Committee. “Government can’t help itself. It doesn’t matter what side of the aisle you’re from.”

Critics of “pay-go” chide conservatives for not trusting perhaps even themselves to deliver fiscal austerity when the GOP has supermajorities of 32-8 in the Senate and 92-33 in the House. Opponents argue that the rule will stifle debate and make it harder to correct obvious mistakes that come to light after a committee has finished its work.

“I think everybody in a chamber needs to be able to exercise their votes on what is the amount of our budget,” said House Minority Leader Paul Davis, a Lawrence Democrat. “The Legislature is capable of deciding those questions.”

Budget committees and their leaders have struggled for years to maintain their influence when the entire House or Senate debate an annual spending plan, even though most often a GOP-dominated panel has presented that plan to a Republican-controlled chamber. Spending regularly ballooned as individual members proposed amendments for specific projects or to provide additional dollars for aid to public schools, social services or local property tax relief.

GOP conservatives in the House imposed their version of “pay-go” after two years of seeing a coalition of Democrats and moderate Republicans sidestep the chamber’s conservative leaders to pass budgets.

“It has forced us to live within some boundaries,” Kelley said.

Supporters of a “pay-go” rule contend it stymies attempts by one faction of lawmakers to propose large amounts of new spending, knowing that the state can’t afford it, just to force a recorded “gotcha” vote that later can be cited in campaign literature against an incumbent. Votes in committee generally aren’t recorded, unless a member specifically asks to be listed as voting yes or no in the minutes of a meeting.

Senate Ways and Means Committee Chairman Ty Masterson, a conservative Andover Republican, advocated having “pay-go” added to the Legislature’s joint rules, which cover interactions between the two chambers, rather than having the Senate include the provision in the rules that govern its internal operations. Masterson noted that if the provision is in the joint rules, both chambers must follow it, and one can’t remove the requirement without the other’s consent.

“It makes it stronger,” he said.

The Senate approved its version of the joint rules, 28-11, with all but one yes vote coming from conservative Republicans. The House Rules Committee plans to review the package Tuesday, and Chairman Clark Shultz, a Lindsborg Republican, said GOP leaders hope to have the entire chamber vote Thursday.

Critics of the “pay-go” rule don’t hold out much hope of blocking its adoption in both chambers, but they’re trying to get Kansans to see it as undemocratic.

They argue that it concentrates power to set the total amount of spending in the hands of a relatively few lawmakers, 12 of 23 House budget committee members and six of 11 senators serving on their chamber’s panel.

“It just is foolish to do that sort of restriction,” said Sen. Laura Kelly of Topeka, the ranking Democrat on the Senate Ways and Means Committee. “It takes away the voice of every legislator.”

Senate President Susan Wagle, a conservative Wichita Republican, said such fears are unfounded, because a majority in each chamber still can return budget legislation to committee for more work.

“It’s our goal to prioritize spending,” she said. “The Legislature is a very flexible institution that responds to the needs of the people.”
