Judge orders disclosures in military school suit

A Kansas military school’s refusal to identify students who were branded with hot metal while attending during the past five years “borders on the absurd,” a federal judge said Tuesday, ruling that St. John’s Military School must disclose that information along with most other records sought in a lawsuit alleging a culture of abuse.

The decision by U.S. Magistrate Judge Kenneth Gale comes in the federal lawsuit filed by 11 former cadets and their families against the Salina boarding school. The students contend the school’s quasi-military cadet program, which gives higher-ranking cadets the power to discipline students, encourages physical and mental abuse. The plaintiffs — who hail from California, Florida, Tennessee, Colorado, Texas and Illinois — filed the lawsuit in March.

St. John’s has vehemently denied a culture of abuse exists at the school and has vowed to fight the lawsuit.

Neither side immediately responded to emails seeking comment on the development in the case.

The latest legal wrangling comes as the sides exchange information in preparation for the October 2013 trial.

Plaintiffs had filed a motion for the judge to compel the school to give them certain information after the school refused to do so. The judge ordered the school to disclose most of the material within 60 days, but rejected the plaintiffs’ request for sanctions because the court had also denied or limited some of the discovery requests.

Gale’s most scathing criticism addressed the school’s refusal to identify students who had been branded. The school had objected to that request, calling it “overly broad and unduly burdensome” because it would have to search over 1,000 student records.

“The Court finds Defendant’s position borders on the absurd,” Gale wrote in his ruling. “The Court cannot fathom that Defendant does not have information readily available regarding which students have been branded during the past 5 years. Regardless, the information is relevant and discoverable.”

Among the 11 plaintiffs in the current lawsuit is a Tennessee student who alleges he was forcibly branded on his stomach as a rite of initiation. Similar allegations of brandings have also surfaced in earlier lawsuits.

An abuse lawsuit that was settled last year included photos of a cadet’s arm that had been branded with a star shape as part of his initiation into “headquarters company.” A school official acknowledged in a deposition in that earlier lawsuit that at least 10 other students were similarly branded, but the school did not investigate them, court records show.

St. John’s had also balked at disclosing information about prior lawsuits filed on behalf of students, arguing the request was overly broad. Gale agreed, limiting the required response to lawsuits filed within the past 10 years involving allegations of student-on-student abuse, hazing or similar matters.

Plaintiffs have long contended that at least nine other abuse-related lawsuits have been filed against St. John’s since 2006, but a cursory examination by The Associated Press of both federal and state court filings in Saline County found at least 14 lawsuits filed since 2003 by cadets and their families.

The judge also ordered the school to turn over complaints or statements made by former or currents students regarding abuse, harassment or hazing over the past five years; police reports regarding abuse complaints; photographs and videos identifying student abuse, hazing or harassment; and internal reports or memos regarding complaints of abuse.

The Episcopal boarding school, which charges families nearly $30,000 per year for students enrolled in grades 6-12, draws students from across the nation.
