Kansas awaits word on No Child Left Behind waiver

The head of the Kansas Department of Education said Wednesday it’s not certain that the state will be granted its waiver request from the federal government for more flexibility under the No Child Left Behind Act.

Diane DeBacker said in an interview with The Associated Press the state continues to negotiate with the U.S. Department of Education over a request to use an alternative system for measuring student and school achievement.

The state’s waiver request has been a topic of discussion during a school finance trial in Shawnee County District Court. Attorneys for plaintiff students and school districts are asking a three-judge panel to declare the state’s funding of education unconstitutional, in part because it fails to provide adequate resources to educate all students.

The Kansas waiver seeks permission to use a performance index for measuring academic success, similar to the state’s “standard of excellence” program for rewarding schools for results on state assessments tests.

“It would do away with annual yearly progress and all the measures would be based on their own performance and if they improved from the year before,” DeBacker said.

She said the system would recognize gains that schools and school districts make on the assessments and move toward proficiency goals in reading and math, even if they fall short of the exact target percentage.

DeBacker said federal education officials have raised concerns that the system would be “masking performance in the lower achievement categories.” If the waiver is denied, Kansas would have to reach the 2011 targets for math and reading proficiency by 2014.

DeBacker said Kansas would be talking to federal officials about the request on Friday and should know more about the waiver’s chances. She said if it becomes clear that Kansas won’t get the waiver granted before the start of school in the fall, the state could drop its request entirely.

“Everything would be business as unusual. That is a bit of relief for the schools, but it still doesn’t do what we want and that’s giving credit for growth and improvement,” DeBacker said.

Last year, President Barack Obama invited states to apply for greater flexibility under the law to reach goals for student achievement. The law is scheduled to be reauthorized by Congress in 2013.

State Board of Education member Sally Cauble said Kansas has a unique formula for assessing growth in test scores, but the bigger issue is how the state will evaluate teachers. Cauble said she “feels good” about Kansas’ chance of getting a waiver.

“We’re going to get it,” she said. “What it looks like, we don’t know.” In the court case, state’s attorney Arthur Chalmers suggested that Kansas waiver application was “a given” and that the state would receive permission to use alternative measures for student achievement.

While being cross-examined, Kansas City, Kan., superintendent Cynthia Lane questioned Chalmers’ assessment of the waiver’s chances, noting that a request sought by her urban district wasn’t approved in its entirety.

“I don’t think anything is a given,” Lane said.

Chalmers has described the achievement requirements as unrealistic and unreachable, regardless of how much money is spent.

The trial is expected to last three weeks and is likely to be appealed to the Kansas Supreme Court, regardless of the lower court’s ruling.
