Kan. City schools leader: Cuts hurting students

Cuts in state education spending have forced the Kansas City school district to eliminate programs and staff aimed at boosting student achievement, the district’s superintendent testified Tuesday as part of a lawsuit that accuses Kansas of failing students.

Superintendent Cynthia Lane took the stand for the second day in the case being heard by three Shawnee County judges. The lawsuit was filed on behalf of students, parents and 54 school districts, including some from Kansas City, alleging the state is not meeting a constitutional requirement to provide suitable education to every student.

Lane said her urban school district of about 20,000 students has tried to mitigate the reductions, but that they’re beginning to impact student achievement. About 88 percent of the district’s students qualify for free school lunches.

“No, we are not providing our students with a suitable education as it’s defined by the state,” Lane said when answering questions from the plaintiffs’ attorney, Alan Rupe.

Legislators increased school spending by nearly $1 billion in 2006 following a Kansas Supreme Court ruling in a similar 1999 lawsuit that forced the state to hike its education funding. However, lawmakers began cutting back when state revenues declined, and eventually school districts and parents filed the new lawsuit to compel the state to restore that funding.

During cross examination Tuesday, Lane was asked by the state’s defense attorney if any amount of money would be enough to satisfy her and her district’s goal of meeting the educational needs of all students. The attorney, Arthur Chalmers of Wichita, suggested that the district just wants to see its funding continually increase.

Lane said it’s about restoring eliminated programs that were producing gains in reading and math scores.

“No, it’s not just about more money. It’s about having resources to meet the needs,” she said.

Chalmers argued that the goals and expectations of school districts were based on the federal No Child Left Behind Law, which set a national goal of 100 percent proficiency in math and reading by 2014. He said that was unrealistic and noted that several states, including Kansas, are seeking waivers to be exempt from the standard.

“No matter how much money you infuse in the system, no matter how hard you work at it, you’re never going to reach your goal, are you?” he asked Lane, who responded: “What I want is for our kids to be successful. I want whatever it takes.”

The trial, which is expected to last three weeks, is being heard by Judges Franklin Theis, Robert Fleming and Jack Burr. But their decision will almost certainly be appealed to the Kansas Supreme Court.

Chalmers said that while public focus is often on the base state aid that districts receive for each student, there are more funds available, including additional amounts based on district demographics, local property taxes and federal funds.

Lane said the formula wasn’t broken or needed to be rewritten, but additional funding would make it function as intended and cover district expenses.
