Analysis: Kan. tax debate may spur more shortcuts

When massive tax cuts cleared the Kansas Legislature last week, recriminations followed over how both chambers truncated debates as the House tried to rush the legislation to Gov. Sam Brownback and the Senate simultaneously tried to block it.

Legislators caught on the losing end in both chambers worried that traditions of unfettered debate were in danger. Recent history suggests unusual maneuvers in the Legislature can become commonplace.

Lawmakers need look no further than their now-routine “gut and go,” a move that strips a bill of its contents and substitutes another proposal. The tactic sparked outrage when it was employed two decades ago to force the House to debate a major anti-abortion proposal, but now it’s used regularly each year to speed measures to passage.

The legislators who moved last week to end what they saw as filibusters over tax cuts argued that the unusual circumstances won’t recur often. But it’s not difficult to envision a Kansas Legislature in which majorities, bored with opposing arguments and wanting to move favored bills, regularly squelch debate.

“We talk about protecting the institution, where we come together to conduct the people’s business,” said Sen. Pat Apple, a conservative Louisburg Republican. “Are we going to spiral down to mob rule?”

The tax legislation would cut individual income tax rates, eliminate income taxes for 191,000 businesses and drop the state’s sales tax to 5.7 percent in July 2013 from its present 6.3 percent. Gov. Sam Brownback, a conservative Republican who pushed for income tax reductions, plans to sign the bill unless another, less aggressive plan he likes emerges.

Brownback contends the tax cuts will stimulate the economy and create new jobs. But the Legislature’s research staff projects that a budget shortfall will emerge by July 2014, growing to almost $2 billion by July 2017.

The unusual tactics employed last week to pass the plan included a “gut and go.” The bill heading to Brownback was introduced last year in the House to make technical changes in sales tax laws. It passed the House and remained in a Senate committee for a year — until senators needed a “vehicle” or “shell” for tax cuts.

The plan passed the Senate, where many members thought it too aggressive but — after a push by the governor — approved it to keep the legislation moving. The House and Senate negotiated a compromise, but many senators still had misgivings.

The Senate planned to vote on that compromise Wednesday. The House’s conservative Republican leaders, fearing the Senate’s moderate GOP leaders would let the plan die, set a House vote on the Senate’s more aggressive version.

The chamber voting first would prevail. In the House, Democrats and moderate Republicans attacked the more aggressive tax plan as irresponsible. In the Senate, which convened a little later, GOP conservatives began speaking.

Rep. Lance Kinzer, a conservative Olathe Republican, relied on a seldom-used rule to force a vote on cutting off the House’s debate. In the Senate, John Vratil, a moderate Leawood Republican, interrupted Sen. Jeff King, a more conservative Independence Republican, and forced a vote on whether King’s speech was out of order. Kinzer and Vratil prevailed in their chambers, but the House voted first.

In the House, GOP conservatives were castigated as tyrants. In the Senate, they did the castigating of GOP moderates.

Recriminations also followed a February 1990 meeting of the House Transportation Committee. The committee stripped a minor transportation bill of its contents, turned it into an anti-abortion measure and sent it to the House for a debate that abortion rights supporters had blocked for years. That day profoundly influenced the Legislature, weakening the power of committee chairmen and other leaders to block bills. But leaders stung by the “gut and go” also co-opted it.

Previously, legislation had been far more difficult to pass than to kill. Now, officials regularly joke about wanting to be buried at the Statehouse because nothing truly dies there.

House Speaker Mike O’Neal, a conservative Hutchinson Republican, is skeptical Wednesday’s events will have the same kind of influence, seeing them as “pretty unique.”

But in the Senate, David Haley, a Kansas City Democrat, had speeches interrupted on two consecutive days by senators asking whether his comments were in order.

And O’Neal acknowledged having to tamp down talk among House members about trying Kinzer’s tactic again when debates become tedious. “I don’t know how serious it was,” O’Neal said. “But it was, like, ‘Hey, that was pretty cool. It worked the other day.”’

Such sentiments mean the tactics employed last week are likely to be used again in the future — perhaps with growing regularity.
