Basehor residents recall mayor, 2 council members

Residents of an eastern Kansas town that has been roiled by controversy since a city manager was fired have overwhelmingly recalled the mayor and two City Council members, who were on opposite sides of the issue.

Basehor Mayor Terry Hill and council members Dennis Mertz and Iris Dysart were recalled in a special election Tuesday, with about 65 percent of voters approving Hill’s recall, 61 percent Mertz’s and 59 percent Dysart’s, The Lawrence Journal-World reported.

Residents had mounted dueling efforts to remove the three after the firing of former City Administrator Mark Loughry. One committee targeted Mertz and Dysart, who supported the firing, and the other sought to recall Hill, who opposed it.

The group opposing Mertz and Dysart alleged that the two council members violated the Kansas Open Meetings Act by having discussions related to Loughry’s firing outside of a public council meeting. The council members denied the accusation.

The committee seeking Hill’s recall accused the mayor of improperly revising Loughry’s contract to give him additional health benefits and authorizing a $50,000 severance check to Loughry without approval from the council. The mayor denied those charges, saying both actions were lawful.

Under state law, the three officials will be removed from office the day election results are certified, which is expected to occur next Monday. Hill, Mertz and Dysart will be the first elected officials ever to be recalled in Leavenworth County. Nearly 30 percent of the city’s residents voted in the election, far above figures from the last several regular City Council elections.

Mertz said he believed voters were confused by accusations from the group seeking to recall him and Dysart and decided to throw out everyone.

“I think they may have said, ‘Enough’s enough and let’s start fresh,”’ Mertz said.

Marilyn Townsend, a Basehor resident who led the effort to recall the mayor but supported Mertz and Dysart, said she was “at a loss for words” after all three officials were recalled.

“I would never have believed this community would do this,” she said.

Bob Stonacek, a resident who supported the recall effort against the two council members, said he was disappointed that the mayor also was recalled. He guessed that voters upset about the conflicts at City Hall thought it was necessary to change the city’s administration.

“The message probably got out too strong,” Stonacek said.

Hill and Mertz were elected in 2009 and had a year left in their terms. Dysart was first elected in 2003 and re-elected twice. Her term ends in 2015.

One of the three remaining council members — Fred Box, David Breuer and Travis Miles — will be appointed council president. The council will make the appointment.

Whoever is chosen will then become mayor. The person can appoint three replacement council members, with approval from the rest of the council.

Tuesday’s turnout easily surpassed those in the last three local elections in Basehor, in 2011, 2009 and 2007, which hovered around 18 percent.
